Do grandchildren have a right to grandfather’s property? Thinking of leaving your property behind for your grandchildren? Here’s what you should know.
A grandchild’s right to his or her grandfather’s property depends on the nature of the property the grandfather has – whether it is self-acquired property or ancestral property.
Ancestral property
Property inherited by a Hindu from his father, grandfather or grandfather’s father, is ancestral property. Any property that passes undivided down four generations of male lineage is called ancestral property. The grandson’s right to a share in this property accrues by birth itself. This is different from other kinds of inheritance, where inheritance opens only on the death of the owner.
Ancestral property rights are determined on the basis of per stirpes and not per capita. Therefore, first, each generation’s share is determined and then successive generations sub-divide what has been inherited by their respective predecessors. In an ancestral property, grandsons have an equal share on the same.
According to a Supreme Court ruling, a daughter can only claim ancestral property if her father died after the amendment of the Hindu law. The apex court said that a daughter’s right to ancestral property does not arise if the father died before this amendment, which came into force in 2005.

Self-acquired property
Indian law concerning Hindus is very clear that self-acquired intestate (no will made) property only of the deceased male/female Hindu is inherited by his/her sons and daughters in equal proportion along with the surviving spouse. The grandsons or granddaughters have no right to inherit or claim any share in the property of the grandfather or grandmother if their own father or mother are alive. The grandchild does not have a birthright on the self-acquired property of the grandparent. The grandparents can transfer the property to whoever they wish in a will.
We asked our legal expert Shiv Kumar to shed more light on this and here is what he had to say: Whether grandchildren have a right to their grandfather’s property depends upon whether such property is joint family property or the self-acquired property of the grandfather. If the property is joint family property (HUF property) the grandchildren would also be entitled to a share depending upon the number of members or coparceners of such joint family. However, in the case of self-acquired property of grandfather, no such right vests in any person much less grandchildren to inherit the grandfather’s property. The grandfather would have absolute rights to dispose of his property in any manner of his choice, including by Will.

My grandfather died in 2006. Later on his demise in 2008 my both uncles took rights on my grandfather's property without knowing my mother who is also a legal daughter of my grandfather. In the self aquired property of father who dies without a will in 1959,and the daughter releases her right of her share to her brother in the presence of magistrate court in 2018 by appearing in person twice,and subsequently the court gives the judgement by agreeing to tranfer her shares to the brother and one year after the daughter of the sisters moves an application saying that the brother has fraudulantly taken the signature without the knowledge of her mother , 1.my question is whether court agrees to reppen the case because mother has agreed to release her right to her brother by appearing in court personally in 2 appearence before the judge. 2.is there any time bar to appeal. 3.whether the daughter has any right to move the court ,because the her mother has appeared 2 times before the court and cannot be said as fradulant. 4.the brother has given her part of the amount agreed as per the mutual compromise amount. 5.what will happen to the application to reopen the case again even after accepting 50 %of the agreed amount and that the mother has transferred her amount received by her from her brother .

My Great Grandfather's property & Grandfather's property was decreed in favour of my Father & Uncle after 35 years of legal battle. My uncle was in the Army after stepping out he did his Law at the age of 60yrs. He then started filing cases after cases . Finally when it reached FDP, he still kept pinching filing cases . Unfortunately my Dad passed away at the age of 93yrs , my uncle followed my Father to. As the partition was between my Father and Uncle . One clarification, the courts divided the property as 4/9th & 4/9 th between the two of them. This happened much earlier to 2005 before the Succession Act. Now , how can court partition the property between three Grand Daughters ( married 40yrs back) and one Grandson. My Father passed away this year 2019 followed by my Uncle.

I have a Query regarding the property of my grandfather that he is ready to make a gift deed to me right now but my parents are alive so if in case i died then only my spouse and childrens have the rights on my property not my father and mother.....?????

Hi my grand father have 2 children one son and my mother, my mother brother 3 months back he had sale of agreement but not sale deed and misguide to my mother and taken release deed with registed office.my ? is it can cancel the release deed by mother. 2. i can have rights about that property

my father in law passed away leaving a house which according to his will is divided equally among his two sons. My daughter lives with me and i am divorced from my husband who is the younger son. Now i am concerned if my daughter has the right to her grand fathers property or no. Secondly does she have the right to her fathers share that he will get and should i claim it in the court before they sell it and disperse the money.

As per the sections 6 and 8 of the Hindu Succession Act, you have rightfully inherited the grand father's property as your father's legal heirs. Your uncles have no right or claim over the same.

Hindu Succession Act clearly mandates that the father's share in the property will devolve on his sons and daughters and not his brothers i.e. your uncles. They have no right/claim to the property that you inherited as your father's heir.

My Father died before the death of my grand father. I am 30 years old married and have 3 kids. I have two sisters, one sister is married and other sister is studying. My grandfather and grandmother has self acquired property on their names. but both of them died. My father also died, As a grand daughter will I have any rights from my grandfather and grand mother property. Please suggest
